TERMS AND CONDITIONS

Welcome to BAXTER. These Terms and Conditions (“Terms”) govern your access to and use of the website, digital products, mobile applications, consulting services, educational materials, tools, resources, and other services provided by Baxter Admissions Consulting, LLC (“BAXTER,” “we,” “us,” or “our”).
By accessing our website, purchasing a BAXTER product, using the BAXTER app, engaging BAXTER for consulting services, or otherwise using our services, you agree to these Terms. If you do not agree to these Terms, please do not use our products or services.
1. ABOUT BAXTER
Baxter Admissions Consulting, LLC provides educational college-planning resources, technology, and consulting services designed to help students and families navigate high school planning and the college admissions process.
BAXTER currently offers several levels of support, including:
The BAXTER Method — a self-guided four-year college-planning resource.
BAXTER — a guided digital experience delivered through the BAXTER mobile application.
BAXTER Consulting — personalized college-planning and admissions consulting services.
Products, services, features, availability, and pricing may change over time.
2. EDUCATIONAL PURPOSE
BAXTER provides educational information, planning tools, organizational resources, and guidance. BAXTER does not control and cannot guarantee any student's admission to a particular college or university, receipt of scholarships or financial aid, academic performance, test scores, or other admissions-related outcomes.
College admissions requirements, institutional policies, testing requirements, financial-aid rules, deadlines, and other information may change. Although BAXTER works to provide accurate and useful information, families remain responsible for verifying requirements and deadlines directly with colleges, universities, testing organizations, government agencies, and other applicable primary sources.
Nothing provided by BAXTER constitutes legal, financial, tax, or mental-health advice.
3. THE BAXTER METHOD
The BAXTER Method is a proprietary educational resource created and owned by Baxter Admissions Consulting, LLC.
Purchase of The BAXTER Method grants the purchaser a limited, non-exclusive, non-transferable license to use the Method for the personal educational use of the purchasing household.
Purchase does not transfer ownership of The BAXTER Method or any intellectual-property rights in its content.
Unless BAXTER provides prior written permission, purchasers may not:
reproduce or distribute The BAXTER Method, in whole or in substantial part;
forward, email, upload, post, publish, or otherwise share copies with individuals outside the purchasing household;
sell, resell, sublicense, rent, or commercially distribute the Method;
make copies for another family, school, organization, counselor, consultant, business, or other third party;
upload the Method or substantial portions of it to publicly accessible websites, file-sharing platforms, databases, repositories, or similar services;
remove or obscure copyright, trademark, attribution, or other proprietary notices; or
use BAXTER's proprietary materials to create, market, or develop a competing commercial product or service.
A purchaser may print a reasonable number of copies for personal use within the purchasing household.
Additional copies or licenses for schools, organizations, counselors, consultants, groups, or other users require written authorization from BAXTER.
4. DIGITAL PRODUCT DELIVERY
Digital products are generally delivered electronically to the email address provided at checkout or through another delivery method identified at the time of purchase.
Purchasers are responsible for providing a valid email address and maintaining access to it.
If you purchase a digital product and experience a delivery problem, contact us at contact@baxterac.com so we can assist you.
5. PRINTED PRODUCTS
BAXTER may offer professionally printed versions of certain products in the future.
If printed products are offered, additional charges, shipping costs, production times, fulfillment terms, and return policies may apply and will be disclosed at the time of purchase.
Purchase of a printed copy does not alter the intellectual-property ownership or personal-use license described in these Terms.
6. BAXTER MOBILE APPLICATION
Access to the BAXTER mobile application may require a paid subscription.
App subscriptions purchased through Apple's App Store or another third-party marketplace are also subject to the applicable marketplace's payment, billing, cancellation, and subscription terms.
Features, content, curriculum, functionality, and availability may evolve as BAXTER improves the product.
Unless otherwise stated, an app subscription provides access to the applicable BAXTER services only while the subscription remains active.
7. BAXTER CONSULTING
BAXTER Consulting provides individualized educational planning and college-admissions guidance.
The exact scope, duration, fees, responsibilities, and deliverables associated with consulting services may be governed by a separate consulting agreement. If a separate written agreement conflicts with these general Terms regarding consulting services, the separate agreement will control for those services.
Consulting does not guarantee admission, scholarships, financial aid, academic results, or any particular outcome.
8. PRICING AND PAYMENT
Current pricing is displayed on the BAXTER website, applicable checkout page, App Store listing, proposal, or service agreement.
BAXTER may offer introductory pricing, promotional pricing, discount codes, complimentary access, or other special offers from time to time.
Prices may change prospectively without notice. A price change does not retroactively alter a completed one-time purchase.
Payments may be processed by third-party payment providers, including Stripe, Apple, or other providers. Your payment information may therefore also be subject to the applicable provider's terms and privacy practices.
9. PROMOTIONAL CODES AND COMPLIMENTARY ACCESS
BAXTER may issue promotional codes, discounts, complimentary licenses, or other special offers at its discretion.
Promotional codes have no cash value, may be subject to expiration or eligibility requirements, and may not be sold or transferred unless expressly permitted.
Receiving The BAXTER Method at a discounted or complimentary price does not alter its personal-use license or intellectual-property protections. All restrictions on copying, sharing, redistribution, resale, and unauthorized use continue to apply.
10. REFUNDS AND DIGITAL PRODUCTS
Because digital products may be delivered or made accessible immediately after purchase, purchases of downloadable digital products are generally final once the product has been delivered or access has been provided, except where otherwise required by law.
If you experience a technical problem, duplicate charge, delivery failure, or other purchase issue, contact contact@baxterac.com.
Refunds for consulting services, subscriptions, printed products, or other offerings may be governed by the terms applicable to those particular services.
11. INTELLECTUAL PROPERTY
The BAXTER name, branding, logos, curriculum, educational frameworks, written materials, worksheets, graphics, videos, databases, tools, software, app content, website content, and other original materials are owned by or licensed to Baxter Admissions Consulting, LLC and may be protected by copyright, trademark, and other intellectual-property laws.
Except for the limited rights expressly granted under these Terms, no license or ownership interest is transferred to users or purchasers.
Unauthorized reproduction, distribution, publication, resale, commercial exploitation, or creation of derivative commercial materials from BAXTER's proprietary content is prohibited to the extent permitted by applicable law.
12. USER ACCOUNTS
Certain BAXTER services may require an account.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account. You agree to provide accurate information and to notify BAXTER if you believe your account has been accessed without authorization.
Accounts and paid access may not be shared outside the individuals or household authorized by the applicable product or service.
13. USER-SUBMITTED INFORMATION
Some BAXTER services may allow students or families to enter information, upload documents, complete worksheets, save responses, or otherwise provide content.
You retain ownership of information and materials you submit, subject to the rights reasonably necessary for BAXTER and its service providers to operate, maintain, and provide the requested services.
Our collection and handling of personal information is described in our Privacy Policy.
14. THIRD-PARTY SERVICES AND LINKS
BAXTER may reference or link to third-party websites, colleges, testing organizations, payment providers, technology platforms, or other services.
BAXTER does not control those third parties and is not responsible for their content, availability, policies, accuracy, security, or practices.
15. ACCEPTABLE USE
You agree not to use BAXTER's website, application, products, or services to:
violate applicable law;
interfere with the security or operation of BAXTER systems;
attempt unauthorized access to accounts, systems, or data;
distribute malicious software;
scrape, systematically extract, or reproduce proprietary BAXTER content for unauthorized purposes;
impersonate another person; or
infringe BAXTER's or another party's intellectual-property rights.
16. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, BAXTER's products and services are provided on an “as available” basis without warranties of specific educational, admissions, financial-aid, scholarship, or other outcomes.
BAXTER does not warrant that every piece of information will remain current indefinitely or that services will always operate without interruption or error.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Baxter Admissions Consulting, LLC and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of BAXTER products or services.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
18. CHANGES TO PRODUCTS AND SERVICES
BAXTER may update, revise, expand, discontinue, or otherwise modify its products, curriculum, features, technology, pricing, and services over time.
Material changes affecting an existing paid service will be handled in accordance with applicable law and any governing purchase or service agreement.
19. PRIVACY
Use of BAXTER products and services is also subject to our Privacy Policy, available on the BAXTER website.
20. GOVERNING LAW
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute arising from these Terms or BAXTER's services will be handled in accordance with applicable law and any dispute-resolution provisions contained in a separate agreement governing a particular BAXTER service.
